A report in February by CheckPoint HR found found 39 percent of small- to mid-sized businesses in the New York tri-state area plan to hire this year - a trend that may encourage New York LLC filing.

While the Big Apple has emerged from the economic recession relatively better than other jurisdictions, the hiring trend is increasingly spreading nationwide. According to a report released this week by payroll services company Paychex, checks per client - all of which are considered small businesses - grew by 2.8 percent in the quarter ending February 28, compared to the same period a year ago.

The data provides further evidence to other recent small business employment reports finding hiring to be on the rise throughout the sector.

"The upward momentum is very impressive. Disproportionately, job growth comes from the small business sector [which is] key to a self-sustaining expansion," Jim O'Sullivan, chief economist at MF Global in New York, told Bloomberg Businessweek.

This month, Treasury Secretary Timothy Geithner has expressed his optimism for the sector, citing improvements in the availability of credit as vital to such a recovery.
